NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. THESE RULES GOVERN ALL ASPECTS OF PARTICIPATION AND PRIZE AWARDS.
1. Promotion. Welcome to the JWS Money Moves Streaming Giveaway presented by Ally (“Giveaway”). No purchase necessary to enter or win this Giveaway, and no deposit, entry fee, or proof of purchase is necessary to participate in this Giveaway. The Giveaway is void outside the fifty (50) United States and the District of Columbia and where prohibited by law. The Giveaway is subject to all federal, state, and local laws.
2. Sponsor. This Giveaway is sponsored by Just Women’s Sports, Inc. (the “Sponsor”) , who may be contacted by email at [email protected], or by mail at Just Women's Sports, 8605 Santa Monica Blvd, PMB 72622, West Hollywood, California 90069-4109. For avoidance of doubt, Ally Financial Inc. (“Ally”) shall solely be deemed an advertiser for purposes of these Official Rules (“Rules”) and shall bear no responsibility for the sponsorship or administration of this Giveaway. Further, this Giveaway is in no way sponsored, endorsed, or administered by, or associated with, Meta Platforms, Inc. (“Meta”). Any questions, comments or complaints regarding this Giveaway should be directed to Sponsor.
3. Giveaway Period. The Giveaway shall commence at 12:00 PM EST on July 1, 2024 (“Start Date”) and conclude at 5:00 PM EST on July 19, 2024 (“End Date”). The period from the Start Date to the End Date shall be known as the “Giveaway Period”. Sponsor’s computer or that of its designee is the official timekeeper for this Giveaway.
4. Acceptance of Rules. By submitting an entry, each entrant agrees that he or she has reviewed and accepts these Rules and the Sponsor’s Privacy Policy. Each entrant agrees to abide by these Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Giveaway. Each entrant acknowledges and accepts that their email address will be subscribed to communications from Just Women’s Sports and Ally. An email address is required to enter the Giveaway. Should multiple users of the same address enter the Giveaway and a dispute arises regarding the identity of the entrant, the authorized account holder of the email address associated with the entry, at time of submission, will be deemed the entrant. The “authorized account holder” is the natural person assigned to the email address by the applicable email service provider. Potential winners may be required to show proof of being the authorized account holder. If you participate via your mobile phone, such activity will be subject to the charges pursuant to your wireless service provider’s rate plan. Please consult your wireless service provider for more information.
5. Eligibility. To be eligible for the Giveaway, as of the start of the Giveaway Period, entrants must (i) be legal residents of the 50 United States or the District of Columbia, (ii) be at least eighteen (18) years old and have reached the age of majority in their state of residence, and (iii) have Internet access and an email account. The officers, directors and employees of the Sponsor, Ally, and each of their subsidiaries and affiliated companies, advertising, promotional agencies, and persons engaged in the development, production, or distribution of materials for this Giveaway, and the immediate family members (grandparent, parent, child, sibling, and spouse) of each and/or persons living in the same household as such individuals (whether related or not) are not eligible to participate in the Giveaway.
6. How to Enter. To enter the Giveaway, eligible participants must complete one of the following entry methods during the Giveaway Period:
Facebook/Instagram Entry. During the Giveaway Period, targeted advertisements promoting the Giveaway (“Giveaway Ads”) will appear in the feeds of certain Facebook and Instagram users. Such users may enter the Giveaway by clicking on the Giveaway Ad and then completing and submitting the entry form on the resulting page. The entry form will require each entrant to:
a) Provide your first and last name
b) Provide your valid email address
c) Provide confirmation of eligibility
Website Entry. An entry can also be submitted by visiting the website located at justwomenssports.com/moneymoves and completing and submitting the entry form located there. The entry form will require each entrant to:
a) Provide your first and last name
b) Provide your valid email address
c) Provide confirmation of eligibility
No software-generated, robotic, programmed, script, macro, or other automated entries are permitted. LIMIT: only one (1) entry per person is permitted. Sponsor discourages the creation of multiple email or social media accounts. Any entries discovered to have been submitted by the same individual using multiple accounts will be disqualified. Entries that are incomplete or do not adhere to these Rules or other specifications provided by Sponsor may be disqualified at the sole discretion of Sponsor. Entrants must complete all requirements and provide all information required by Sponsor to successfully submit an entry. Incomplete or illegible entries, as determined in Sponsor’s sole discretion, will be deemed invalid. All entries become the property of Sponsor and none will be returned.
7. Prize: Each winner will receive the following prize:
a. One (1) 12-month subscription to WNBA League Pass via a $35 gift card to the Apple App Store or Google Play Store [8] (Approximate retail value (“ARV”): $35.00)
b. One (1) 12-month subscription to ESPN+ (ARV: $110.00)
The total ARV of each Prize is $145 [9] USD. Aggregate ARV of all prizes available in the Giveaway is $4,930.00.
Prize may be subject to additional terms and conditions; winners should review all terms and conditions accompanying prize and/or presented to winner during registration for WNBA League Pass and ESPN+. Incidental expenses and all other costs and expenses which are not specifically listed as part of the prize in these Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the prize are solely the responsibility of the potential winner. Actual prize may differ from promotional images. Actual retail value may vary, and Sponsor will not award the difference between the ARV and actual value. Prizes are non-transferable and are not redeemable for cash. No prize substitutions allowed, except that Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value. All prize details not specified herein shall be determined solely by Sponsor. By accepting a prize, each winner acknowledges compliance with these Official Rules. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER.
ALL PRIZES ARE AWARDED AS IS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS MAY NOT ALLOW (OR MAY LIMIT) DISCLAIMERS OF CERTAIN WARRANTIES, IN WHICH CASE THE FOREGOING DISCLAIMERS WILL BE ENFORCED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
8. Selection of Winner. After the end of the Giveaway Period, thirty-four (34) potential winners will be chosen at random and will be announced on or about July 24, 2024. The potential winners will be contacted via email at the email address provided in their entry (the “Potential Winner Notification”) and given instructions on how to contact the Sponsor to claim the prize. Each entrant is responsible for monitoring his/her email inbox for Potential Winner Notification or other communications related to this Giveaway. Sponsor shall have no liability for a potential winner’s failure to receive any notifications due to spam, junk e-mail, or other email account settings or for potential winner’s provision of incorrect or otherwise non-functioning contact information.
THE FAILURE OF A POTENTIAL WINNER TO RESPOND TO THE POTENTIAL WINNER NOTIFICATION AND COMMUNICATE PRIZE ACCEPTANCE IN THE MANNER REQUIRED BY SPONSOR WITHIN TWO (2) DAYS AFTER THE POTENTIAL WINNER NOTIFICATION IS SENT WILL RESULT IN FORFEITURE OF THEIR PRIZE.
Upon the request of the Sponsor, the potential winner may be required to return an Affidavit of Eligibility, a Liability and Publicity Release, a Prize Acceptance Form, and/or an IRS W-9 form. Sponsor may require the potential winner to complete other documentation deemed necessary to claim the prize. If the potential winner cannot be contacted, fails to respond to any notifications in accordance with Sponsor’s instructions, is ineligible, is deemed to have violated these Rules, or fails to timely complete and return any documentation or information required by Sponsor, the prize may be forfeited and an alternate potential winner may be selected, in Sponsor’s sole discretion; provided, however, that Sponsor reserves the right not to seek an alternate potential winner.
Subject to verification of eligibility and compliance with the these Rules and all other requirements and instructions of Sponsor, the potential winner will be declared an official winner of the Giveaway.
The odds of winning the Giveaway depend on the number of eligible entries received. The purchase of any goods or services will not increase any Participant’s chances of winning.
9. Publicity. Acceptance of a prize shall constitute and signify (a) winner’s agreement and consent that Sponsor and its designees may use the winner’s name, city, state, likeness, photo, entry and/or prize information for promotional, advertising, or other purposes, worldwide, in any and all media now known or hereafter devised, without limitation and without further payment, notification, permission, or other consideration, except where prohibited by law, and (b) winner’s agreement to complete any documentation requested by Sponsor to memorialize the foregoing consent.
10. Additional Terms and Conditions. The decisions made by the Sponsor or its agents regarding the Giveaway including, but not limited to, those regarding eligibility, winners, rules, prizes, and compliance with the Sponsor’s standards of conduct, are final and binding. Further, Sponsor reserves the right to cancel or suspend the Giveaway or modify it in any equitable manner for any reason, including, without limitation, if any fraud, technical failures, or any other factor beyond Sponsor’s control (including, without limitation, disease, epidemic, or pandemic) impairs the integrity or proper functioning of the Giveaway or otherwise prevents the Giveaway from running as planned, as determined by Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion, select a winner from all non-suspect entries received prior to such event, though Sponsor will have no obligation to select a winner or award any prize. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the operation of the Giveaway or to be acting (or to have acted) in violation of the Rules or in an unsportsmanlike or disruptive manner and void all associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Rules shall not constitute a waiver of that provision. All interpretations of these Rules and decisions by Sponsor are final and binding in all matters related to the Giveaway. The Prize may not be awarded if an insufficient number of eligible Entries are received, as determined in Sponsor’s sole discretion.
11. Dispute Resolution: Except where prohibited by law, as a condition of participating in this Giveaway, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Giveaway, including those related to any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction.
12. RELEASE. BY ENTERING THE GIVEAWAY, ENTRANTS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, ALLY, META, AND THEIR ADVERTISING, PUBLIC RELATIONS, AND PROMOTIONS AGENCIES AND THEIR RESPECTIVE PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS AND DIRECTORS (COLLECTIVELY, “RELEASED ENTITIES”), FROM ANY AND ALL LIABILITY FOR ANY LOSS, HARM, DAMAGE, INJURY, COST, OR EXPENSE WHATSOEVER, INCLUDING, WITHOUT LIMITATION, CLAIMS BASED ON PROPERTY DAMAGE, PERSONAL INJURY AND/OR DEATH, PUBLICITY RIGHTS, DEFAMATION, INVASION OF PRIVACY, COPYRIGHT INFRINGEMENT, TRADEMARK INFRINGEMENT, OR ANY OTHER INTELLECTUAL PROPERTY-RELATED CAUSE OF ACTION, ARISING IN CONNECTION WITH (A) PARTICIPATION IN THE GIVEAWAY, (B) THE POSSESSION, ACCEPTANCE, AND/OR USE OR MISUSE OF ANY PRIZE, (C) PARTICIPATION IN ANY GIVEAWAY-RELATED ACTIVITY.
WITHOUT LIMITING THE PRECEDING PARAGRAPH, ENTRANT HEREBY WAIVE ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE, AND ENTRANT FURTHER WAIVES ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED.
13. Choice of Law: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Rules, or the rights and obligations of entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the substantive laws of the United States (including federal arbitration law) and the State of New York.
